By accessing and using Smart Radio, you accept and agree to be bound by these Terms of Service, our Privacy Policy, and the YouTube Terms of Service. If you do not agree to these terms, you must not use this service. These terms constitute a legally binding agreement between you and Smart Radio.
Smart Radio is a music discovery and organization platform that allows users to: (a) search for and organize YouTube videos using a tagging system; (b) create personalized playlists and mixes based on tags; (c) play YouTube videos through the official YouTube embedded player; (d) create or join listening rooms to enjoy synchronized music playback with others in real-time. All video content is streamed directly from YouTube; we do not host, download, or redistribute any video content.
This service uses the YouTube API Services. By using Smart Radio, you agree to be bound by: (a) YouTube Terms of Service (https://www.youtube.com/t/terms); (b) Google Privacy Policy (https://policies.google.com/privacy). Videos are played exclusively through the official YouTube IFrame Player API. We do not circumvent, disable, or interfere with YouTube's security features, content protection, or usage restrictions. We do not extract, download, or separate audio from videos. All YouTube branding and player controls remain visible and functional.

You may create an account using email/password or Google OAuth. You are responsible for: (a) maintaining the confidentiality of your credentials; (b) all activities under your account; (c) notifying us immediately of unauthorized access. Anonymous users may join public listening rooms with a nickname but have limited features. We reserve the right to suspend or terminate accounts that violate these terms.
Listening rooms enable real-time synchronized music playback and chat. Room owners control playback and member permissions. By using listening rooms, you agree to: (a) respect other participants and maintain civil discourse; (b) not share illegal, harmful, hateful, or inappropriate content; (c) not spam, harass, or abuse other users; (d) comply with room owner rules. We reserve the right to close rooms and ban users who violate these guidelines without notice.
You agree NOT to: (a) download, copy, or redistribute YouTube content; (b) circumvent YouTube player restrictions or content protection; (c) use automated systems to access the service (bots, scrapers); (d) upload unlawful, harmful, or offensive content; (e) impersonate others or misrepresent affiliation; (f) interfere with or disrupt the service infrastructure; (g) attempt unauthorized access to systems or data; (h) use the service for commercial purposes without authorization; (i) violate any applicable laws or third-party rights.
All video content is owned by respective YouTube content creators and rights holders. Smart Radio does not claim ownership of any YouTube content. Our service interface, code, and branding are protected by copyright and trademark laws. User-generated content (tags, room names, chat messages) remains yours, but you grant us a license to use it for service operation.
We respect intellectual property rights. Since we do not host video content (only links to YouTube), copyright concerns about video content should be directed to YouTube. For concerns about content on our platform (user-generated tags, room content), contact us at: dmca@smartradio.app. We will respond to valid takedown requests within 48 hours.
We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. We may: (a) modify, suspend, or discontinue features at any time; (b) perform maintenance with or without notice; (c) limit features based on geographic location or usage. Listening rooms may be automatically closed after 24 hours of inactivity.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE CONTINUOUSLY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify and hold harmless Smart Radio and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of the service; (b) your violation of these terms; (c) your violation of third-party rights; (d) content you share in listening rooms.
These terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation first, then binding arbitration if necessary.
We may update these terms at any time. Material changes will be notified by: (a) posting updated terms with a new "Last updated" date; (b) displaying a notice within the application. Continued use after changes constitutes acceptance. If you disagree with changes, you must stop using the service and delete your account.
